Open Meetings Act - covers all?

Up until today I would have bet all your money that the the Open Meetings Act covered the legislature. But then, today, somebody popped this bubble. So I had to re-read the Act.

Here's the first part of the law:

5 ILCS 120/1) (from Ch. 102, par. 41)
    Sec. 1. Policy. It is the public policy of this State that public bodies exist to aid in the conduct of the people's business and that the people have a right to be informed as to the conduct of their business. In order that the people shall be informed, the General Assembly finds and declares that it is the intent of this Act to ensure that the actions of public bodies be taken openly and that their deliberations be conducted openly.

Here it is again, with certain words emphasized:

Then the Act goes along and defines "public body".

"Public body" includes all legislative, executive, administrative or advisory bodies of the State, counties, townships, cities, villages, incorporated towns, school districts and all other municipal corporations, boards, bureaus, committees or commissions of this State, and any subsidiary bodies of any of the foregoing including but not limited to committees and subcommittees which are supported in whole or in part by tax revenue, or which expend tax revenue, except the General Assembly and committees or commissions thereof.

Now look at some of the key words:

"Public body" includes all legislative, executive, administrative or advisory bodies of the State, counties, townships, cities, villages, incorporated towns, school districts and all other municipal corporations, boards, bureaus, committees or commissions of this State, and any subsidiary bodies of any of the foregoing including but not limited to committees and subcommittees which are supported in whole or in part by tax revenue, or which expend tax revenue, except the General Assembly and committees or commissions thereof.

Now look again at the last nine words of that section: except the General Assembly and committees or commissions thereof.

So it appears that "public bodies" - those about which the legislature wants us to be informed and whose actions are to be taken openly and whose deliberations are to be taken openly do not include the Illinois General Assembly - that being the Illinois House of Representatives and the Illinois Senate and their committees.

Why am I surprised by this? Why didn't I expect that those high-and-mighty public servants would figure out a way to pull a fast one on the public? A clue was given to me on Friday, when one Representative on the House Judiciary Committee said, "We are all lawyers up here."

So there is has been, all the time, for us to know the truth. That the General Assembly does not exist to aid in the conduct of the people's business and people do not have a right to be informed of the conduct of their business. It is the intent of the General Assembly that its action shall not be taken openly and that their deliberations will not be conducted openly.

Business as usual... Ahhh, now I remember ... this is Illinois ...

Illinois State Representative Mike Tryon (R-Crystal Lake) has joined the co-sponsors of HB0997, this session's concealed-carry bill. Thanks, Mike!

There are now 47 co-sponsors of this Bill.

Illinois is under court order to come up with a law (i.e., a passed bill, signed by Gov. Quinn) by June 9, permitting concealed-carry in Illinois.

On February 13 it was assigned to the Judiciary Committee, which has wasted no time in scheduling hearings. Hearings were held in Springfield today and yesterday, and one is scheduled in Chicago for Friday.

Watch Sen. Rand Paul (R.-Kentucky) as he takes off on a 600-page bill he received that was to be voted on before he and other U.S. Senators had time to read and understand it. He received the bill that morning and expected a vote on it that day.

Of course, reading it and understanding a bill are two different things.

And by the time you could read a 600-page bill, think somebody might have slipped in some changes?

It shouldn't matter what political party you are. Voting on something you don't know about should never happen.

If you have been anywhere near the campustown on certain Fridays in March, and come up with a huge throng of greenish looking leprechauns, don't start pinching yourself to see if you are dreaming or not. You have just stumbled into the "Unofficial Saint Patrick's Day" in Chambana.

Here is what UofI wiki has to say about it:

Unofficial Saint Patrick's Day, or commonly known as Unofficial, is a local event on the Urbana-Champaign campus, which aims to replace the celebration of the official Saint Patrick's Day holiday with excessive drinking of alcohol.

Champaign bar owner Scott Cochrane created the event to increase business because the week of spring break on the academic calendar usually includes Saint Patrick's Day, which leads students to celebrate away from the campus.

The event is celebrated usually the weekend before the official Saint Patrick's Day holiday. Bars might open as early as 7 a.m., and students wear T-shirts with slogans such as "Drink 'til you're Irish" or "Irish I were drunk." One T-shirt slogan read: "Tap the keg, forget the class... it's Unofficial, so fill my glass!"


Things are not really as rosey as the above note suggests. On this day, you'll find a lot of underage drinkers, passed out here and there, or coming to class drunk. The police (Champaign, Urbana, County, and of course UofI ones) have a field day ... and nab a lot of underage drinkers.


However, things can often get deadly ... a few years ago, a UofI alumnus died when the motor bike she was riding crashed into a pole on Wright street between Green and Springfield. So, be careful when you are driving through campustown , better avoid going through the area altogether.


There is of course, the "official" Saint Patrick's day, but the drinking frenzy is much less on that one.

Judiciary Committee hearing on concealed carry

The Illinois House Judiciary Committee held a meeting on concealed carry this morning in the Chicago Loop at 160 N. LaSalle Street. The meeting room was just off Speaker Mike Madigan’s office, and his staff was set up to demand a driver’s license from all arrivals (except press) and photocopy that driver’s license before returning it and admitting the person.

I objected, because it was an open meeting of a public body, and I’ll be filing a complaint with the Attorney General’s office and submitting a Request for Review. As I left after the hearing, I asked that the photocopy of my license be returned to me and a staffer refused, saying it would be filed securely. When I asked if it would be shredded, he said it would not.

When I asked where to sign up to speak, I was directed from a woman at the entrance to a man in the hearing room. He told me to have a seat in the second row. A few minutes later, I overheard someone say that you had to be registered to speak, so I went back to the entrance and asked how to get on the list. It turned out that the list of speakers was closed, so Speaker Madigan’s staff had willfully and intentionally misdirected me twice.

Just before the meeting started, NRA lobbyist Todd Vandermyde told me that the U.S. 7th Circuit Court had declined Attorney General Lisa Madigan’s request for a full-court review of the December 11th decision by the three-judge panel that the Illinois prohibition of concealed carry was unconstitutional.

When the meeting started, it was a dog-and-pony show right from the top.  Many speakers encouraged the panel to create gun-free zones, such as in hospitals and government buildings. The Executive Director from the Illinois Restaurant Association wanted all places in the state that serve alcohol to be gun-free zones, even to the customer who did not drink alcoholic beverages. Women from Moms Demand Action were there in force.

Cook County Board President Toni Preckwinkle was there. The gang from mass transit (CTA, RTA, Pace) was there; they don’t want guns on public transportation.

One of the most embarrassing speakers was Chicago Police Department Supt. Garry McCarthy. You do not want to ask him what time it is. Two hours later, he won’t have taken a breath and you still won’t know what time it is. He doesn’t have a clue how to stop gun violence. He couldn’t even describe clearly how an interaction between a legally-armed driver stopped for a traffic violation and a cop ought to go; he kept calling it a “confrontation”.  He even mentioned that a cop might handcuff a driver while he sorted out legal possession of a firearm.

When asked about training for a concealed-carry license, McCarthy launched into the training required for police officers. And McCarthy wasted far too much time talking about strawman purchases.

Rep. Drury (D-58) hammered Todd Vandermyde about whether the NRA would agree to a waiting period for the effective date of the concealed carry law. Todd responded that the 7th Circuit Court had ordered a law be in effect in 180 days.

With all the scare talk by the anti-gunners, not one person gave a clear example of when an armed, licensed civilian might shoot. Speakers don’t want Illinois to become the Wild, Wild West and fear that over-crowding on the ‘L’ will result in shootings by civilians. How stupid.

Maybe it’s good that I didn’t get to testify. I would have given them an example like a passenger on the ‘L’ who shoots, but only after some punk gets on at Halsted and starts shooting passengers. Wouldn’t they want an armed citizen available to intervene, or would they just want a bunch of bodies on the ‘L’?

Mama's on the Half Shell - Canton, Baltimore

Hey Everyone! The FI (still getting used to writing that) and I met up with college friends for a relaxing weekend lunch. They took us to a popular seafood spot - Mama's on the Half Shell in Baltimore. Thankfully there was zero line when we arrived because we passed one going out the door as we were leaving. It is in the city, so parking can be found on the street.

The place is pretty small, thus creating the line of waiting patrons. It is two levels of dark, colonial looking decor which looks like 'Baltimore seafood place'. Not sure what that means, but it fits! The vibe is casual, but airing on the nicer side.

Our friends ordered a 1/2 pound of Steamed Jumbo Shrimp with chipotle lime cocktail sauce, drawn butter and bread ($9.99). The shrimp were big, and delicious eaten with the sauteed onions. The cocktail sauce didn't taste like it had chipotle lime in it, but was still good.

I was craving Cream of Crab, so I ordered the closest thing on the menu. The Seafood Chowder ($6.99) had shrimp, scallops, clams and applewood smoked bacon in a heavy cream base. It was so good and satisfying. It was quite heavy so if I didn't want to stuff myself (which is never), then I could just eat this as my lunch.

Our friends high recommended this ginormous sandwich! What you see below is only HALF. The Seafood Club ($14.50) comes with a 3 oz crab cake, shrimp salad, lettuce, tomato, mayo, smoked applewood bacon and swiss cheese. You also have the option of fried oysters instead of the crab cake. The shrimp salad had big chunks of shrimp, the bacon was flavorful and you can't go wrong with a crab cake in Baltimore. It's hard to eat because it's so tall, so I took it apart and ended up getting rid of an extra slice of bread in order to fill up on the good stuff.

After our meal we stopped by the famous Vaccaro's to pick up some Italian desserts for the road! A little on the pricey side, and not as sweet as typical desserts.
The service was quick and nice. They sliced the sandwiches for us and I have no complaints. We didn't get a chance to try any raw oysters as their name suggests, but next time!

What a storm! I hope everyone is safe because Sandy was quite destructive, but thankfully our part of Rockville wasn't affected much. Just a few hours without power.

So we haven't started our 'wedding' diet yet, so I'll just continue to write about fattie places like Bobby's Burger Palace. The Fi (I guess that's his new name? Let's test it out.) visited the University of Maryland location. We met at UMCP, and things have changed. We never had nice buildings and restaurants like this when we were there! I'm not that bitter though...

The name is self-explanatory - they serve burgers. Gourmet ones created by Celebrity Chef Bobby Flay to be exact. The interior is bright with warm lighting. It's filled with bar seating/communal tables and very comfortable chairs that spin! It's a casual place where you order/pay at a register, they give you a number, and they bring food out to wherever you are sitting. 

Many of the burgers are named after cities and characterized by a food that represents them. For example: The Fi ordered The Philadelphia Burger is topped with Provolone Cheese, Griddled Onions and Hot Peppers ($7.75). He thought it was good, but nothing out of the ordinary. 

If you're not in the mood for a burger, they offer sandwiches, salads, sides, milkshakes and other beverages. Also, if you don't eat beef, you can substitute the beef patty with turkey or chicken breast.

I wanted a flavor explosion so I ordered the Bobby Blue Burger with Blue Cheese, Bacon, Lettuce, Tomato $7.75), and it wasn't as pungent as I was hoping. Again, it was an ok burger, but nothing particularly special. Ray's Hell Burger's equivalent is much better.

I love Sweet Potato Fries ($3) and these came with a Honey Mustard Horseradish Sauce which was awesome.


If you like dipping sauces, they have a variety including Jalapeño Hot Sauce, Chipotle Ketchup, Burger Sauce, and Barbecue. Sadly none of them really stuck out for me.Overall, we weren't wowed. So if we were visiting our Alma Matar again, we'd probably stop by Cluck U. However, I will say their service was impressive. We weren't there for long, but 3 different times someone would check on us. Pretty nice!

Ah dim sum. I don't get to have it often because the bf doesn't like small dishes...pshhh! Well that's what friends are for! One of my friends took me to Mark's Duck House - her favorite spot for Sunday dim sum. The restaurant has been around for over 20 years serving Hong Kong-style cuisine. As their name suggests, they are known for their Peking Duck. However, we didn't get a chance to try it.
Located in a shopping center, there is plenty of free parking, but it can get crowded.

This place is smaller than other restaurants that offer dim sum, so it was PACKED! We took a number when we got through the crowd waiting by the door.

They offered many of the same dishes I'm used to seeing as well as some different items. Sorry guys, but I don't have prices for any of these items because they were in Chinese. All dishes are between $2.50 - $7.50 though.

1. Pan-Fried Chives Dumpling - Out of all the dumplings, this was my favorite.
2. Shrimp and Pork Dumpling (Shiu Mai)
3. Shrimp and Pork Dumpling
4. Shrimp Dumpling (Har Gao)

5. Fried Taro Dumpling - One of my favorite dishes when I have dim sum.
6. Shrimp Noodle Crepe - Best noodle crepe I've tried.
7. Lemongrass and Ginger Oyster - Oyster by itself was the size of my palm.
8. Stuffed Crab Claw - I broke my chopstick trying to cut this. It was massive!
Service was very fast with the carts, they constantly filled our water glasses, replaced my broken chopstick and reminded me that I forgot my leftovers. I thought they were great! Food was on point. Now I just need more dim sum buddies!

Do you have a gun in the house?THIS IS GOOD TO KNOW!

When I had my  gallbladder taken out and spent 10 days in the hospital. I had home nurse visits for two weeks and was asked if I had guns in the house. I respond that if I did I would not tell them. So the below has some merit.

FYI, I am passing this along... there are comments from two other people that have also been asked if they keep guns in the house. The nurse just kinda slipped it in along with all the other regular questions. I told her I refused to answer because it was against the law to ask.

Everyone, whether you have guns or not, should give a neutral answer so they have no idea who does and who doesn't. My doctor asked me if I had guns in my house and also if any were loaded. I, of course, answered yes to both questions. Then he asked why I kept a loaded gun close to my bed. I answered that my son, who is a certified gun instructor and also works for Homeland Security, advised me that an unloaded, locked up gun is no protection against criminal attack.

The Government now requires these questions be asked of people on Medicare, and probably everyone else.

Just passing this along for your information: I had to visit a doctor other than my regular doctor when my doctor was on vacation.. One of the questions on the form I had to fill out was: Do you have any guns in your house?? My answer was None of your damn business!!

So it is out there! It is either an insurance issue or government intervention. Either way, it is out there and the second the government gets into your medical records (as they want to under Obamacare) it will become a major issue and will ultimately result in lock and load!!

Please pass this on to all the other retired guys and gun owners... Thanks, from a Vietnam Vet and retired Police Officer: I had a doctors appointment at the local VA clinic yesterday and found out something very interesting that I would like to pass along. While going through triage before seeing the doctor, I was asked at the end of the exam, three questions: 1. Did I feel stressed? 2. Did I feel threatened? 3. Did I feel like doing harm to someone?

The nurse then informed me that if I had answered yes to any of the questions I would have lost my concealed carry permit as it would have gone into my medical records and the VA would have reported it to Homeland Security.

Looks like they are going after the vets first. Other gun people like retired law enforcement will probably be next. Then when they go after the civilians, what argument will they have? Be forewarned and be aware. The Obama administration has gone on record as considering veterans and gun owners potential terrorists. Whether you are a gun owner, veteran or not, YOU'VE BEEN WARNED !

If you know veterans and gun owners, please pass this on to them. Be very cautious about what you say and to whom.

What's going on with the case of Daniel "Potatoe" Huber, driver of a second car at the time of the 2:00AM single-car, fatal crash on July 1st that killed two 16-year-old boys near Woodstock.

Huber has another court date on Thursday, February 28. On that date a 402 Conference is already scheduled. Is there a deal coming?

Thanks to careful work by the specially-trained deputies at the McHenry County Sheriff's Department, Huber was tracked down. He is charged with drag-racing and other felonies and is alleged to have been at or near the scene of the crash, but left without rendering aid or calling for help.

A video tape from the Marathon gas station on Route 47 south of Highway 14 showed Huber there at the same time as Jacob Norys and Alec Kaiser. A Woodstock Police officer, never identified in the press, apparently talked to Norys and Kaiser but may have only asked them if they were old enough to smoke. Had he quizzed them further, he would have determined that neither was authorized to drive the car they were in, due to their ages and restricted driver's licenses.

Toxicology reports on Norys and Kaiser showed marijuana in both bodies. Who is the drug dealer who sold them the marijuana? Is anyone at the McHenry County Sheriff's Department investigating this?

It can't be that hard to learn where they got the drugs. Ask their friends. They are or were probably buying from the same person. Could Huber know the dealer(s)? Will he reveal the name or names? Maybe hoping for a little break in his own case?

Where is the news reporting about it? Did not the sheriff's department inform its favorite newspaper? Promptly? Is there some reason that the newspaper did not publish the information?

Even if all the paper reported was that ____ _____ died at her home on Monday morning, it's news. Paramedics from ___ responded, as did deputies from the McHenry County Sheriff's Department. And probably the Coroner's office.

Was it a death from natural causes? Accidental? Were there suspicious circumstances? Had the person been under any reported stress or threats?

If the death was on Monday morning and this is Wednesday afternoon, hasn't enough time elapsed for the press to provide some information? Once the public knows, you never know what additional information might show up.

When I moved to Illinois in 1996, one of the first phone calls I made was to inquire how to get a concealed carry license application.

An officer at the Woodstock Police department, then smaller and located in the basement at Woodstock City Hall, directed me to the sheriff's department.

I called the McHenry County Sheriff's Department and spoke with a deputy  He laughed out loud and said I would never get a concealed carry permit in Illinois!

I wish I had recorded his name. If he is still with the sheriff's department, I hope he'll call me now. I suspect he has retired, but perhaps he'll read this and call me, or perhaps another department will know of his joking remark to me.

I'm not interested in the "last laugh", although I remember the sentence ("He who laughs last, laughs best") from years ago.

The day is almost here,when law-abiding Illinois residents will be able to apply for and get a concealed-carry permit (called "license" in the legislation that is pending).

The topic of "shall issue" or "may issue" arose in yesterday's Judiciary Committee hearing in Springfield. I sincerely hope the decision will be in the hands of the State Police and that, if a person meets the qualifications, the license "shall" be issued.

Putting the decision in the hands of a county sheriff or police chief will result in delay and unnecessary expense. In an Iowa case, a sheriff denied the application of a law-abiding citizen who had been a political opponent. The case went to court, and the judge bashed the sheriff - properly.

Just imagine if Sheriff Nygren had a chance to throw a monkey wrench into my own application. Would he? Or would he be man enough to just stamp my application "No objection" and send it quickly on its way?

What a storm! I hope everyone is safe because Sandy was quite destructive, but thankfully our part of Rockville wasn't affected much. Just a few hours without power.

So we haven't started our 'wedding' diet yet, so I'll just continue to write about fattie places like Bobby's Burger Palace. The Fi (I guess that's his new name? Let's test it out.) visited the University of Maryland location. We met at UMCP, and things have changed. We never had nice buildings and restaurants like this when we were there! I'm not that bitter though...

The name is self-explanatory - they serve burgers. Gourmet ones created by Celebrity Chef Bobby Flay to be exact. The interior is bright with warm lighting. It's filled with bar seating/communal tables and very comfortable chairs that spin! It's a casual place where you order/pay at a register, they give you a number, and they bring food out to wherever you are sitting. 

Many of the burgers are named after cities and characterized by a food that represents them. For example: The Fi ordered The Philadelphia Burger is topped with Provolone Cheese, Griddled Onions and Hot Peppers ($7.75). He thought it was good, but nothing out of the ordinary. 

If you're not in the mood for a burger, they offer sandwiches, salads, sides, milkshakes and other beverages. Also, if you don't eat beef, you can substitute the beef patty with turkey or chicken breast.

I wanted a flavor explosion so I ordered the Bobby Blue Burger with Blue Cheese, Bacon, Lettuce, Tomato $7.75), and it wasn't as pungent as I was hoping. Again, it was an ok burger, but nothing particularly special. Ray's Hell Burger's equivalent is much better.

I love Sweet Potato Fries ($3) and these came with a Honey Mustard Horseradish Sauce which was awesome.


If you like dipping sauces, they have a variety including Jalapeño Hot Sauce, Chipotle Ketchup, Burger Sauce, and Barbecue. Sadly none of them really stuck out for me.Overall, we weren't wowed. So if we were visiting our Alma Matar again, we'd probably stop by Cluck U. However, I will say their service was impressive. We weren't there for long, but 3 different times someone would check on us. Pretty nice!

Ah dim sum. I don't get to have it often because the bf doesn't like small dishes...pshhh! Well that's what friends are for! One of my friends took me to Mark's Duck House - her favorite spot for Sunday dim sum. The restaurant has been around for over 20 years serving Hong Kong-style cuisine. As their name suggests, they are known for their Peking Duck. However, we didn't get a chance to try it.
Located in a shopping center, there is plenty of free parking, but it can get crowded.

This place is smaller than other restaurants that offer dim sum, so it was PACKED! We took a number when we got through the crowd waiting by the door.

They offered many of the same dishes I'm used to seeing as well as some different items. Sorry guys, but I don't have prices for any of these items because they were in Chinese. All dishes are between $2.50 - $7.50 though.

Bull Valley PD nails good-deed doer

"No good deed shall go unpunished." You've heard that one; right?

I thought things had changed a little in Bull Valley, Illinois, after a new police chief took office. The P.D. has for a long time had a reputation of tough enforcement of traffic violations.

I don't find anything particularly offensive about that, because so many drivers today flagrantly violate traffic laws, such as speeding laws, red lights, stop signs, tailgating and other moving violations.

There are appropriate times to issue a warning, instead of a ticket. And an officer needs a valid reason to make a traffic stop in the first place. In the Winter 2013 issue of the newsletter of the McHenry County State's Attorney's Office is an article citing People vs. Hackett, about "probable cause" and "reasonable suspicion" and how the latter might be a lower standard for a traffic stop.

So what is this about a tractor (pictured (click on image to enlarge it)) and the Bull Valley P.D (not pictured)? Last week this tractor was being delivered to the Hooved Animal Humane Society (HAHS) on McConnell Road, east of Route 47 in Woodstock. A HAHS Board member had donated the tractor, and a driver borrowed a trailer and drove to west of the Wisconsin Dells to pick it up. As he was passing through Bull Valley and almost at his destination, he got stopped.

As the driver passed Thompson Road on Route 120, he saw two Bull Valley PD squad cars. One of the cops pointed at him as he passed, and he figured he was about to get stopped. Which he did. The cop first thought the trailer with the tractor was over-weight. Everything was in order with license and registration. Then the cop wrote the driver a ticket because there was no inspection sticker on the borrowed trailer.

For $120 it's pretty hard to fight a ticket. If it was processed through McHenry County Circuit Court, there would probably be $200-250 in court costs if the driver fought the ticket and lost. If the ticket was processed in Bull Valley's administration adjudication court, there would probably be at least $100 tacked on for "court costs", if the driver sought a hearing on the ticket and lost.

The tractor had been donated. The trailer had been loaned. The driver volunteered his time to go to the Wisconsin Dells area to pick up the tractor and even had to make two trips, because the tractor wouldn't fit on the first trailer he took to get it.

A special donation was made to HAHS to pay the driver's ticket. And so HAHS has "donated" $100 to Bull Valley. Thanks, HAHS.

Next time you go through Bull Valley, be sure to think kind thoughts toward the ever-vigilant officers who are keeping the streets and roads safe for all. Was it right for the cop to stop the truck and trailer because he "thought" it might be over-weight? As soon as he found out that it wasn't over-weight, does his authority for the stop expire?

The HAHS Board member called the Bull Valley P.D. Chief last week and left a phone message for him. He has probably been super busy counting up all the tickets issued by his officers; maybe he still intends to return that call. Maybe...

Timothy Smith's trial is set for Monday, February 25.

In Judge Prather's court today, the motions that were in the way were cleared away, reducing the possibility that the trial will be delayed - at least for those reasons.

Judge Prather does a good job of being heard in the courtroom when she calls a case. After that? She lowers her voice so that it can barely be heard beyond the lawyers at the bench, and she allows the lawyers to speak in tones so low that they cannot be heard in the courtroom.

Why is McHenry County so prone to keep the public in the dark as to what is said at the bench? It would be an easy matter for judges to direct the lawyers and witnesses to speak up and for the judges themselves to speak loudly enough to be heard. No one needs to shout - just speak in normal tone of voice.

If the bailiff keeps the noise down in the courtroom and in the vestibule, everybody will be able to hear everything.

So what happened today? It sounded like Judge Prather okayed calling Kimberly Smith, Timothy's wife, as a witness. Some people think that a wife doesn't have to testify against her husband, but one of the Motions in limine clarified that. The lawyers obviously know the law; the judge knows the law. The point of the Motion was, probably, to get it on the record and avoid the issue in court.

What was covered in the Motion? Generally speaking, one spouse might not have to testify against the other spouse. The prosecution wants to call Kimberly Smith in Timothy's trial.

The prosecution expects that Kimberly will refuse to testify and will invoke her right against self-incrimination. BUT a judge can grant immunity to Kimberly, and it sounded like that was what Judge Prather did this morning. Because Judge Prather could not be heard clearly in the courtroom, I'm having to guess at this, and I could be wrong.

According to the Motion filed by the prosecution that was heard in court this morning, if Kimberly refuses to testify in Timothy's trial, then the prosecution believes that Kimberly could be found in contempt of court for refusing to testify. After all, whatever she says in court cannot be used against her in her own trial that is scheduled to start in March, so why shouldn't she answer questions?

Kind of a Catch-22, isn't it?

By granting immunity, could this mean that the prosecution is, in effect, willing to throw out its case against Kimberly in its effort to convict Timothy?

So we haven't started our 'wedding' diet yet, so I'll just continue to write about fattie places like Bobby's Burger Palace. The Fi (I guess that's his new name? Let's test it out.) visited the University of Maryland location. We met at UMCP, and things have changed. We never had nice buildings and restaurants like this when we were there! I'm not that bitter though...

The name is self-explanatory - they serve burgers. Gourmet ones created by Celebrity Chef Bobby Flay to be exact. The interior is bright with warm lighting. It's filled with bar seating/communal tables and very comfortable chairs that spin! It's a casual place where you order/pay at a register, they give you a number, and they bring food out to wherever you are sitting. 

Many of the burgers are named after cities and characterized by a food that represents them. For example: The Fi ordered The Philadelphia Burger is topped with Provolone Cheese, Griddled Onions and Hot Peppers ($7.75). He thought it was good, but nothing out of the ordinary. 

If you're not in the mood for a burger, they offer sandwiches, salads, sides, milkshakes and other beverages. Also, if you don't eat beef, you can substitute the beef patty with turkey or chicken breast.

I wanted a flavor explosion so I ordered the Bobby Blue Burger with Blue Cheese, Bacon, Lettuce, Tomato $7.75), and it wasn't as pungent as I was hoping. Again, it was an ok burger, but nothing particularly special. Ray's Hell Burger's equivalent is much better.

I love Sweet Potato Fries ($3) and these came with a Honey Mustard Horseradish Sauce which was awesome.


If you like dipping sauces, they have a variety including Jalapeño Hot Sauce, Chipotle Ketchup, Burger Sauce, and Barbecue. Sadly none of them really stuck out for me.Overall, we weren't wowed. So if we were visiting our Alma Matar again, we'd probably stop by Cluck U. However, I will say their service was impressive. We weren't there for long, but 3 different times someone would check on us. Pretty nice!

Ah dim sum. I don't get to have it often because the bf doesn't like small dishes...pshhh! Well that's what friends are for! One of my friends took me to Mark's Duck House - her favorite spot for Sunday dim sum. The restaurant has been around for over 20 years serving Hong Kong-style cuisine. As their name suggests, they are known for their Peking Duck. However, we didn't get a chance to try it.
Located in a shopping center, there is plenty of free parking, but it can get crowded.

This place is smaller than other restaurants that offer dim sum, so it was PACKED! We took a number when we got through the crowd waiting by the door.

They offered many of the same dishes I'm used to seeing as well as some different items. Sorry guys, but I don't have prices for any of these items because they were in Chinese. All dishes are between $2.50 - $7.50 though.

1. Pan-Fried Chives Dumpling - Out of all the dumplings, this was my favorite.
2. Shrimp and Pork Dumpling (Shiu Mai)
3. Shrimp and Pork Dumpling
4. Shrimp Dumpling (Har Gao)

5. Fried Taro Dumpling - One of my favorite dishes when I have dim sum.
6. Shrimp Noodle Crepe - Best noodle crepe I've tried.
7. Lemongrass and Ginger Oyster - Oyster by itself was the size of my palm.
8. Stuffed Crab Claw - I broke my chopstick trying to cut this. It was massive!
Service was very fast with the carts, they constantly filled our water glasses, replaced my broken chopstick and reminded me that I forgot my leftovers. I thought they were great! Food was on point. Now I just need more dim sum buddies!
