Backers pulled in when the Chicago Machine got to enough Cook County Dems to prevent passage. HB 0148 continues to gather dust in Springfield. Today's Northwest Herald reported on the September 29 shooting north of Marengo, when a deputy attempted to serve an arrest warrant on Edward P. Bolen, 49.

If you want to be totally confused, read the media release on the Sheriff's Department website and then read the story in today's Northwest Herald.

The media release says that "members of the McHenry County Sheriff’s Office Patrol Division went to 2905 Northwest Road, in unincorporated Marengo Township in an attempt to serve a domestic battery warrant on Edward P. Bolen.

"Sheriff’s deputies saw Bolen within the residence and made contact with him and a roommate..."

However, the newspaper article says that Dep. Zane Seipler went to the house. He then contacted dispatch and requested another deputy, after he saw Bolen running in the house. Dep. Robert Chamberlain responded.

Seipler and Bolen went to the back door, and they told another man in the house to leave, whereupon they entered the house (legal entry?) and went to the front door to unlock it for a (third, unnamed) deputy to enter.

Seipler and Chamberlain heard Bolen in the basement and went downstairs. Chamberlain saw Bolen with a gun and yelled out. Seipler took a couple of shots at Bolen, apparently missing him.

Seipler called for SWAT. When they arrived, Seipler went outside to brief them (not "debrief" them, as the NWH article says).

From the newspaper article it looks like another deputy took a couple of shots at Bolen while near and in front of Dep. Chamberlain. Then Bolen threw a gun out of the basement room in which he was hiding.

How can the Sheriff's Department possibly say that it is "unclear" who fired the second set of shots? They must know exactly who fired them. Why aren't they saying? Somebody's gun was dirty and was not fully loaded. Were the shots fired by the third deputy, the one who came in the front door after Seipler and Chamberlain unlocked it? Why doesn't the report mention her (or his) name?

Then the SWAT team entered the basement.

The Sheriff's Dept. media release says that Bolen was hit by two bean bag rounds, after he brandished a knife at (SWAT) team members.

The defense attorney, Dan Hofmann, will have a great time with the reports, if they aren't any clearer than the Dept. media release and the information given to the NWH reporter.

Reports should be clear and logical. And truthful. With them, the reader should be able to figure out what happened. Questions should be answered, not raised.

Bolen has six felony and two misdemeanor charges filed against him in Case No. 12CF000920. There have already been five court dates for motions, and his next court date is November 6.

Bolen was arrested and charged in Lake in the Hills on October 26 for violating an Order of Protection. According to Court records, the OP was entered October 1 and was terminated on October 22. This leads, of course, to the question as to why Bolen was arrested on October 26 for violating it. Did Lake in the Hills fail to check court records before arresting Bolen? Or is there an Order in effect from another County?

For a good look at the sign that may have caused the sign battle in October in District One, take a look at this article on First Electric Newspaper. 

It seems that when the property owner made a deal with the owner of the signpost and billboard out front at 1075 W. Algonquin Rd. (just east of Pyott Rd.), in Algonquin, the fine print in the contract precluded him from allowing any political sign of an opponent.

Frankly, I'm wondering about the legality and ethics of such a contract provision if, indeed, it is part of the contract. When the sign post and platform were erected, did the sign company really know that, at some time in the future, political advertising might be sold on the sign, such as Bob Bless' ad shown in the photograph?

Cannot a person continue to possess his First Amendment rights, or can they be signed away in a contract?

That is the property where Nick Chirikos got permission to place his signs. That's the property where Steve the Enforcer chose to take issue with Nick's sign. And where Steve was arrested. And then un-arrested.

Judge Meyer denies special prosecutor

Judge Meyer this morning denied Sgt. John Koziol's Petition for a special prosecutor to investigate Undersheriff Andy Zinke.

Judge Meyer explained, as he did in Zane Seipler's case, that the investigation should fall to the McHenry County State's Attorney, unless he is sick, absent or unable to attend. "Attend" means to take care of business, as in not having a conflict of interest.

The State's Attorney's Office has apparently had some contact with the Appellate Special Prosecutor's office, although the details did not come out in great detail.

Sgt. Koziol's attorney expressed concerns about the potential for a conflict-of-interest, since the State's Attorney represents the sheriff and the sheriff's department, but his concerns were not persuasive enough for Judge Meyer to grant the request made in the Petition.

The problems identified in the Petition are significant and should receive legal attention. Will they?

Sheriff Keith Nygren was in the courtroom today. At one point an attorney stopped to talk with him, creating a distraction in the courtroom, at least for those seated nearby. Rather than stepping outside the courtroom for their conversation, they just showed bad manners and kept talking.

Nygren's EEO officer, Don Leist, also was in the courtroom and claimed the privilege of sitting in the jury seating area, even though he is not an attorney with an interest in the case. He walked in and out of the courtroom several times and also stopped at the lawyers' tables for conversation.

It's unclear to me why Leist is even in the courtroom, when he would seem to have no interest in the case at all. As the EEO officer, his duties are defined by the sheriff. Leist is not the sheriff's attorney, although he seems to have a hard time leaving his attorney hat on the shelf in his closet at home. If he doesn't have any work to do, perhaps the sheriff ought to consider eliminating the position and saving the $100,000 expense at the sheriff's department.
